Emergency Use Legal

Emergency Use Legal
Every radio regulation on Earth contains the same clause in some form: a person in danger may use any means to summon help. This page is about that clause, its scope, and its limits.
The principle
Radio law exists to manage interference, not to prevent rescue. When a life is genuinely at risk, the justification for transmitting at whatever power is needed is recognized universally, from the FCC’s emergency provisions to the CEPT distress principle. The beacon’s EMERGENCY mode is this principle implemented in firmware.
What the exception covers
| Covered | Not covered |
|---|---|
| A real, ongoing life-threatening situation | Drills and exercises |
| Transmitting to summon help | Transmitting for convenience |
| Power beyond the ISM ceiling | Interfering with active rescue channels |
| The period of the emergency | Days of “what if” operation |
The EMERGENCY mode boundary
The beacon’s EMERGENCY mode exists so the firmware does not make you fight the settings while in danger: it shortens the interval and raises the power with a few button presses. Using it in a drill is a regulatory violation in most jurisdictions, because the exception requires a genuine emergency. The honest alternative for drills: keep the legal power floor and the normal interval, or operate on amateur-licensed channels.
After the emergency
Report what you did. National regulators and amateur societies universally appreciate a written account of a genuine emergency transmission; it protects you and documents the event. Silence afterwards is the mistake.
The cultural note
Every rescue service on Earth would rather hear a false alarm transmission than miss a real one. The law reflects this: the exception errs on the side of life. Use it honestly, use it when it counts, and the system works as designed.
